Welcome to the website and online store of Nushka by Radhika. By accessing or using our website (including browsing, ordering, or purchasing products) you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use our site.

1. Electronic Record

This document is an electronic record in terms of the Information Technology Act, 2000 and rules issued thereunder as applicable and is generated by a computer system. It does not require any physical or digital signatures.

2. Eligibility & Acceptance

You affirm that you are either:

• a legal adult (18 years or older) capable of entering into contracts in India; or
• using the site under the supervision of a parent or guardian who accepts these Terms on your behalf.
  Your use of the website constitutes your acceptance of these Terms, and you acknowledge that you have read, understood and agree to be bound by them.

3. Products, Orders & Availability

• The products offered on our website are for consumer retail use only and are not for resale or commercial distribution unless explicitly authorised by us.
• All orders are subject to availability and confirmation. We reserve the right to refuse or cancel any order for any reason including, but not limited to: (a) product being out of stock, (b) pricing or typographical error, (c) suspicion of fraud or misuse, or (d) limitations on shipping to your location.
• We strive to provide accurate product descriptions, images, and pricing. However, to the fullest extent permitted by applicable law, we do not warrant that product descriptions, colours, or other content are error-free, complete or reliable.
• Prices and availability of products are subject to change without notice.

4. Payment & Pricing

• Payment for the products shall be made through the payment methods listed on our website at the time of checkout (e.g., credit/debit card, UPI, net banking).
• All payments shall be denominated in Indian Rupees (INR).
• You agree to pay the amount shown at checkout, including applicable taxes and shipping (unless waived) when placing your order.
• We reserve the right to disable certain payment methods at our discretion.

5. Shipping, Delivery & Title

• We ship only within India and do not currently ship internationally.
• Free shipping is available for orders above ₹ 1500 (inclusive of taxes).
• Delivery timelines:
  • For the Delhi/NCR region: approximately 2-3 business days after dispatch.
  • For the rest of India: approximately 3-8 business days after dispatch; actual delivery may vary depending on location and courier network.
• Risk of loss and title for items purchased pass to you upon our handing over the parcel to the courier. We are not responsible for delays after dispatch unless explicitly stated.

6. Returns, Exchanges & Refunds

• Because our products are skincare items (health/hygiene-sensitive), returns or exchanges are not accepted once the product has been opened or used.
• We only accept returns/refunds in cases of damaged, defective, or incorrect items, subject to our policy and the procedure outlined in our Shipping, Returns & Refunds Policy.
• If you attempt to return an item for reasons such as “change of mind”, “size/variant preference”, or after opening/using it, we reserve the right to refuse the return.

7. Intellectual Property

• All content on the website (including but not limited to graphics, logos, text, images, video, software) is the property of Nushka by Radhika or its licensors and is protected under Indian copyright, trademark and other intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable licence to view and use the website for personal, non-commercial use.
• You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content without our prior written consent.

8. User Account & Security

• If you create an account on our site, you agree to provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account login and password.
• You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or breach of security.
• We reserve the right to terminate accounts that violate these Terms or for any other lawful reason.

9. User Content & Promotions

• When you post or submit content (photos, reviews, comments) on our website or social channels (“User Content”), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, distribute your User Content in any medium, for marketing or other business purposes, without payment to you.
• You represent and warrant that you own or have the necessary rights to post the User Content and that it does not violate any third-party rights.
• We may moderate, remove or refuse any User Content at our sole discretion.

10. Limitation of Liability & Disclaimers

• Our website and services are provided “as is” and “as available” without warranties, express or implied, to the fullest extent permitted by law.
• We disclaim all implied warranties of merchantability, fitness for a particular purpose, non-infringement.
• To the maximum extent permitted by applicable law, Nushka by Radhika and its officers, directors, employees or affiliates shall not be liable for any incidental, indirect, special, consequential or punitive damages arising out of or related to your use of the website, products purchased, or inability to use the website—even if we have been advised of the possibility of such damages.
• Our total liability to you for direct damages shall in no event exceed the purchase price paid by you for the product in question.

11. Guarantee, Patch Test & Medical Advice

• Our products are cosmetic skincare items and are not intended to diagnose, treat, cure or prevent any skin condition or disease.
• We strongly recommend that you do a patch test before using any new skincare product. If you are under medical supervision, pregnant, have sensitive skin, allergies or any skin condition, please consult your dermatologist prior to use.
• We do not guarantee specific results from use of our products.

12. Force Majeure

We will not be liable or responsible for any failure or delay in our performance of obligations due to causes beyond our reasonable control, including–but not limited to–acts of God, war, riots, civil commotion, strikes, lock-outs, pandemics, governmental actions, courier disruptions, or other force-majeure events.

13. Changes to the Terms

We reserve the right, at our sole discretion and without prior notice, to modify or replace these Terms at any time by posting the updated version on our website. The “Last updated” date will reflect the change. Your continued use of the site after such posting constitutes your acceptance of the updated Terms.

14. Governing Law & Jurisdiction
